Abstract: Employing the right person and managing the employment relationship is crucial to business success. This article outlines legal responsibilities and offers guidelines on the employment of staff. This guide is only about the employment relationship between an employer and an employee and does not cover other ways of engaging workers (such as subcontracting). EMPLOYEES Anyone who agrees to be employed and work for some payment is an employee. This can include wages, salary, commission and piece-rates. The Employment Relations Act 2000 (ERA) states that people who are intending to work (have accepted the job) are also employees and the Employment Relations Authority will look at the nature of the relationship rather than what label it is given if it is asked to decide whether or not someone is an employee.
