The Treaty of Waitangi - a forestry overview.

Abstract: This paper provides an overview of the Treaty of Waitangi and its general relevance to forestry development in New Zealand. It also discusses the role and influence of the Treaty, the Waitangi Tribunal, and the Treaty claims settlement process on the forestry sector since 1985. This paper includes: (1) a brief discussion on the historical background of the Treaty; (2) the Treaty status in New Zealand law; (3) the principles of the Treaty, who establishes these principles and what they are; (4) the Waitangi Tribunal, its composition, jurisdiction and its role in the creation of the Crown Forests Assets Act; (5) the history of the Crown Forests Assets Act 1989; and (6) and a summary of developments (or lack of them) in the Treaty settlement process.
